The Need
Law firms have or are establishing protocols that litigators, paralegals and the Litigation Support Department will follow when dealing with electronic discovery. Protocols address issues such as when and how a litigator should involve Litigation Support in a case, and under which circumstances discovery should go to a vendor. One needs to be careful when instituting protocols in firms where litigators can bypass Litigation Support, as the flood of new work could overwhelm the department.
 

Success

Best practices are only successful when they address the needs of everyone involved: legal team, lit support, vendors, clients and third parties. For those protocols to succeed, they must account for the level of support available today. Good planning, both in terms of protocols and staffing will result in a Litigation Support Department that can provide the goods and services.
